Dubai Courts builds first division for the non-Muslim inheritance and execution of non-Muslim wills. It has been a remarkable initiaitive, where court has achieved a brilliant success rate until now which is more than 90% success rate. The objective of the department is to process the non-Muslim wills with in least period of time, and it also assures that their religious or personal laws will be used. It has been a great step to manage the cultural diversity in Dubai because people of different backgrounds are living in Dubai and they want their decisions related to their lives and assets to be managed the way they want or have, in their countries.
Objective of this new court is to, serve the non-Muslim expatriates in a good way by creating comforts for them and to speed up the inheritance process which were not easier before, for the non-Muslims. It shows the interest of DUBAI government for the non-Muslims living in Dubai. It will develop and increase the confidence of non-Muslim expatriates living in Dubai. This new department is specialised in dealing with the non-Muslims in Dubai.
When a non-Muslim has to open an inheritance case then he has to provide documents. For example these documents including legal notice, details of inheritance, legal memorandums, legal documents about legal heirs, required power of attorneys if needed, asset details, bank account details, asset details etc. Applicant or applicants do have to provide the existing will to special inheritance Dubai court. DIFC courts will are not the part of this process. DIFC Lawyers are for DIFC Courts and DIFC Wills. If any legal heir is not alive then his attested death certifcates must be submitted to court. If the WILL was issued outside the UAE then it has to be attested from UAE Embassy and MOFA before submiting to court. This will outside the UAE is submitted to Dubai Courts after attestation.
This new department applies a single session in court for the final decision. After completion of all the documents stated above, the final verdict has to be issued in one hearing.
