Rules & Regulations for Lawyers

April 21, 2022

Lawyers in UAE e.g. Lawyers in Abu Dhabi, Lawyers in Dubai, Lawyers in Sharjah, and Lawyers in Ajman are also regulated by criminal law like all other citizens. The laws and regulations ensure that lawyers act within the boundaries of the law in their personal as well as professional lives. It is usually believed that lawyers have a greater responsibility to uphold the law. They can’t take the advantage of their legal identity, legal professional and legal knowledge. When a lawyer commits a crime, when he breaks the law, or he goes beyond the legal limits then he can also be arrested. He will also be punished by Public Prosecution, Courts etc. If they do not fulfil their legal duties very well, then they can be taken to DIWAN, the Ruler’s Court. Rules & Regulations for Lawyers are also defined in UAE for Lawyers, Legal Consultants and Law Firms.

Improper Professional Conduct

Professional standards are usually enforced by criminal law. Criminal law usually defines improper professional conduct. For example, deliberately billing a client for services that were not delivered comes under the umbrella of fraud and the responsible party becomes liable for legal action.

Apart from Professional Norms

Apart from professional norms, criminal law also has a major impact on disciplinary codes. Lawyers are liable if found assisting clients in committing crimes or agreeing to cover the crime. The disciplinary codes prevent lawyers from making false claims or statements, presenting forged evidence, or prompting witnesses to lie. Under criminal law, if a lawyer does not take any action but is ready to help and encourage the crime with the promise of assistance as and when needed, such a lawyer is also liable as the lawyer has the intent to promote the crime. Similarly, if a lawyer is aware that a crime is about to be committed but does not take any action to prevent the crime, the lawyer becomes an accessory to the crime.

Role of Lawyers

Lawyers play a major role in helping individuals get justice. Therefore, a lawyer who is found to be involved in improper professional practices can be disbarred and can have their license revoked. A lawyer who acts wrongly is usually expected to repeat their behaviour in the future and therefore, strict action is taken against a lawyer involved in wrongdoing. There are certain instances where the wrongdoing is not related to a lawyer’s legal practice and may not lead to the disbarment of the lawyer. As we stated above that Ruler’s Court or the DIWAN is the court for justice if the client wants to file a case against his attorneys or Law Firm.

General

A major conflict arises when a criminal lawyer has to defend a client who has committed a crime. The lawyer has to argue that the client is innocent while being fully aware that the client is guilty. In such cases, it is essential that the lawyer does not present any perjured evidence or testimony, and presents the case to the best of their ability while remaining within the legal boundaries. Citizens have to pay their taxes fairly without trying to look for loopholes to save taxes. If a lawyer is asked to provide ways to arrange finances in such a way that the client pays minimum taxes, the lawyer must ensure that everything is legal and the client does not go beyond the legal threshold while saving taxes. Similarly, whenever the client tries to get additional benefits or decrease their payables by rearranging their finances, the lawyer should ensure that the client is completely aware of the legal processes and follows the correct procedures. Lawyers in UAE e.g Lawyers in Dubai, Lawyers in Abu Dhabi, Lawyers in Ajman, Lawyers in Sharjah etc are properly regulated by law and their professional conduct is closely monitored to ensure that they do not take part in any sort of wrongdoing.
