UAE always takes the important steps, to make sure that employees are being treated with justice. The labour rights are the top priority, of the UAE government. Domestic workers are also protected as a top priority. Federal Decree Law No 9 of 2022 which is about Domestic Workers, and the Cabinet Resolution No 106 of 2022, are implemented to make sure that “Domestic Workers” and their labour rights are fully protected. This law was implemented on 5th December 2022, defining the employer duties e.g. providing housing and medical expenses.

The domestic worker company must be registered with Migrant Portals of relevant country and all the documentation must be genuine, not fake. Once the domestic worker gets the VISA then the employer has to complete the employment contract with the domestic worker and provide the medical insurance. It’s mandatory now to provide medical insurance to all employees.

Requirements of both countries

When a sponsor has to hire a domestic worker then from other countries then he has to fulfil the requirements of both countries. The sponsor or the company first has to be registered in the migrant portal of the country. Federal Decree Law 9 / 2022 which is about the “Domestic Workers”, directs to maintain a healthy relationship with employees, and to create a work framework in which there must be made no injustice with employees. Federal Decree Law 9 of 2022 is a popular law on domestic workers.

This federal law states that employees must have to know about employment rights, employment agreements etc. Applicant must need to have a UAE resident VISA and a monthly earning of AED 6000. Domestic workers must need to be informed about the job descriptions and other necessary details.

·      Based on Federal Decree Law 9 of 2022 and Cabinet Resolution 106 of 2022, the domestic workers have to be provided with the one day off with 12 hours of daily rest with 8 hours continuous sleep. This Federal Law also provides 30 days annual leave, to all domestic workers. For domestic workers, the airfare has to be managed by the sponsor.

Sick Leaves

There are 30 sick leaves as per the contract in which 15 days have to be paid. If the employee stops coming to work or get disappears then the sponsor can lodge the complaint of suspension or declare absconding.

Salaries

Agreed salaries or any other allowance must be paid as per the contract. Any breach will allow the employee, to open a case against the employer.

Gratuity

Articles 22 and 23 are about the gratuity of these workers. End-of-service benefits must be paid to domestic workers at the time of expiry or cancellation of the agreement.

Penalties

UAE courts have a proper system to deal with domestic employment disputes. Fines, penalties and punishments come through court verdicts.
