Police can check the phone record of husband who is cheating. Article 40 of UAE Criminal Procedure Law provides the right and authority to police officers to check the phone of cheating husband. This is an attempt to collect the evidence against the cheating husband. Based on this investigation, police can make a report and the Criminal Case can be opened further as well. Therefore, wife has to open a police complaint first. This is the, procedure to open Criminal Cases that first police complaint is lodged and based on that, criminal actions are taken in public prosecution and courts. Article 40 of UAE Criminal Procedure Law allows this. Police can mention his cheating, adultery or any other kind of crime in the report.

Divorce without a Reason

As per Law Article 6, 7, and 8 of Federal Decree-Law No.41 of 2022, the non-Muslim wife can ask for Divorce but without any reason. The new law allows this right to Non-Muslim wife. By using the new law, non-Muslim wife can ask for divorce first and can also open a new case for alimony later. This is also called as No Fault Divorce. But for this kind of divorce the marriage has to be in ABU DHABI Civil Courts only, which means marriage certificate should be issued in ABU DHABI only. Both, must be resident of ABU DHABI only. It is annulment of marriage indeed.
