New Surrogacy Law

Surrogacy is a process in which services are taken from another surrogate mother for the child’s birth. There are few countries in the world where it is still not valid. UAE was one of those countries where permission was not granted for IVF or Surrogacy procedures. But now the situation has been changed. Recent Amendments

There are some recent amendments in UAE Law about CHILD BIRTH. The OLD laws were considered invalid in UAE before. After the recent amendments, there have been made several addition and flexibilities. Now people can opt for surrogacy. It has been a very big change until now like few others massive changes in the law, in last few years. Surrogacy is a process in which a woman is hired to deliver a baby. Non-Muslims are also granted the IVF facility without a marriage certificate, which allows the unmarried couples the chance of fertilization.

Muslim and Non-Muslim Couples

Non-Muslim couples can also have access to Surrogacy without a marriage certificate. For Muslim couples, the marriage certificate is necessary. As far as the SURROGATE MOTHER is concerned, then there are no criteria explained that how to choose a surrogate mother. It depends upon the couples or individuals. He can choose as per their choice from any part of the world.

UAE has removed the old laws related to child births through surrogacy and IVF procedures. There is nothing introduced new basically, simply the old rules have been removed where it was not allowed at all. For Muslim couples, they need to have a marriage certificate. But there are some conditions related to Eggs and Sperms as well. Eggs or Sperms of other persons can’t be used. It means sperms and eggs of husband and wife must be used in the surrogacy process with a surrogate mother. This way a woman can have a child who is her child, biologically.

Non-Muslims, can apply for IVF or surrogacy even if they are not married. This relaxation or flexibility is only for the non-Muslims. Non-Muslim couples must be ready to register the children on their name together.
