Marriage Lawyers and Marriage Types
June 26, 2023
Marriage is recognized as a union formed by two people when they get into a personal relationship. It’s a legally accepted and recognized relationship between two people. Marriage is also registered in the region/place where it is conducted or the place, where the couple wants it to be registered.
As per the new amendments in ABU DHABI Law, the ABU DHABI government allows the marriage, of tourists in ABU DHABI. It means tourists can get married without having a residence VISA in ABU DHABI. This is also called Civil Marriage in ABU DHABI for Non-Muslims. Article 4 and Article 5 are about the Civil Family Marriage in ABU DHABI.
The marriage contract is meant to protect the rights of the groom and bride. The rules as per religion and culture can be certainly different than others but the process of documentation remains the same. Marriage Lawyers in ABU DHABI or anywhere in UAE, help the couple to get married legally in ABU DHABI or anywhere in UAE, as well as to complete all the documentation. Our Lawyers do help people anywhere in United Arab Emirates with procedures, solutions and paperwork. We will discuss the several marriage types here:
Marriage: Between Non-Muslims:
Expatriates living in UAE are allowed to get married, in UAE as per their Law or the Law which is implemented in their countries. But the procedures and legalities, ought to be consulted with Lawyers e.g. Family Lawyers in Dubai. The tourists are even allowed to get married but only in ABU DHABI. Article 10 in Federal Law, 2006, is the new addition to Family Law, covering this rule. Now Non-Muslims can get married even on a Visitor or Tourist VISA.
Marriage – Muslims:
Marriage for Muslims can only be arranged with Muslims. Muslims can’t marry other than Sharia Law. Whether a UAE Muslim Citizen or just UAE Muslim Resident, both can only marry in UAE by applying and using Sharia Law. For a bride, there have to be two witnesses and a legal representative.
Inter Religion Marriages:
UAE follows Sharia Law for their own marriages because Sharia Law is the country’s Law here. But if the Law of the applicant’s country is silent on some topics, then Sharia Law is preferred to be used. Therefore, there might be some challenges for people from other religions. Our Advocates and Legal Consultants, do have the professional ability and capability to help people, in inter-religion marriages.
Expats and Nationals: Marriage in UAE:
All the expats and locals, have to follow the rules and laws made by UAE Government. These rules are like getting medical certificates, NOC if required, Residence Permits, the legal age to get married, other required approvals, original passports, birth certificates, original Emirates IDs, previous death certificates, etc.
Family Lawyers:
Our Marriage and Family Lawyers can help you, with Marriage and its registration processes. Apart from that, our Lawyers can also provide legal support, for Divorce, Alimony, Child Custody, as well as asset distribution. Asset Distribution means, the joint assets between husband and wife. The joint assets need to be distributed if bought together by the couple. We will discuss the other roles of Family Lawyers/Advocates here, other than marriage.
Divorce or KHULA is also dealt by Family Lawyers. KHULA is filled by the wife and Divorce can also be filled by either party. When Divorce is filed, whether amicably or disputed, the verdict is taken very carefully by the court. The judges here in UAE, are the expert in their domains. Apart from Divorce, Child Custody, Alimony is also dealt with by Family Lawyers.
Most of the time, child custody, and alimony is also filled along with divorce. At the time of divorce, the wife also applies for child custody and alimony. The process with family lawyers is started with legal consultations and signing the engagement letters. Once the agreement/engagement letter is signed and Power of Attorney is provided to a lawyer, then he can start acting as a Lawyer.
Court Hearings and Court Documentation, need to be managed by the hired lawyers. Please keep in mind that just UAE National Advocates/Lawyers can start representing the clients.
