If confidential information is shared by the employee/employees with competing businesses, then an investigation inside the company can be conducted and, meanwhile, the police complaint can also be registered.
Article 44 Labour Law UAE, provides a provision to the Employer that he can terminate the employee/employees but after conducting a fair and rightful investigation and the investigation must be in written format, if the employee/employees do share the company information with competing companies or with any other source where the shared information can cause a loss. As per Law, to disclose the information is considered a Criminal Act.
If a case is opened and the verdict comes against the employee then he can be punished for 6 months at least, and a fine of at least AED 200, 000. The maximum amount of the fine is AED 1 Million.
