Changes in Personal Status Law UAE

December 31, 2023

United Arab Emirates passed a Federal Decree Law 50 of 2023 which has been an amendment to the last few provisions of Personal Status Law 2005. The amendments are enforced from November 30, 2023. It means it has been implemented officially. We will throw light on Changes in Personal Status Law UAE and few more important points.

1.Dispute Resolution

If there is a serious dispute between a couple, the best action serving children the best, can be taken by the urgent matter judge. Judge has the right to take the decision, in the best interest of the children, considering the competence of the custodial mother. The judge will be free to take the decision in the best interest of children/children.

2.Adult Identification Documents

As per the Law, every individual is granted the right to keep his own passport when he becomes a major. Major means to reach the age of 18. The father is always a guardian by the law, which allowed to keep the passport until the age of 21 before. The individual can have a passport and keep it with him once he crosses the age of 18. Other personal identifications are also the part of it.

3.Education Authority

Previously, the decision authority for the education of children was only for the father. Now, the father still remains still the guardian, but the mother can also be the Education Authority now. Father was only responsible for the education of the child/children before, now custodial mother has the authority as well. This is called as EDUCATIONAL AUTHORITY. But the authority must be exercised in the best interest of children.
