Dispute Resolution Phase

Like Labour and Family Courts, the court system also provides the option of dispute resolution in Civil or Commercial Cases. This is known as “Commercial Dispute Resolution Committee”. This committee is given a task to resolve the matter amicably at this stage and doesn’t encourage both parties to move forward with a court case. But in case if there can be no settlement then the same committee has to issue NOC or Court Referral letter. Based on that letter or permission the plaintiff can register the Civil or Commercial Case against the second party. At this level advocates can’t offer any support except advising about the case, and how to answer in dispute resolution sessions. Once the NOC is obtained then advocates have to register the case.

Case Registration Phase

After the dispute resolution phase, the next phase comes, Case Registration. This process requires details of both parties, statement of claim, supporting documents, case registration memo etc. The case is prepared and submitted for acceptance and Case regimentation.

The case registration department at the Court, carefully examines all the attached documents and legal memos. If something is missing then the missing document or detail is requested. That has to be provided for the completion of the process. After that court fee is paid.

It needs to be noted that jurisdiction applies on the living area of defender. If that is not available or unknown then his/her work area will be considered the area for jurisdiction. Federal Law No.11 of 1992 is the relevant law for defining the jurisdiction area.
